Ohio Appellate Court Dismisses Asbestos-Related Insurance Action, Says Trial Court’s Order Not Appealable

CINCINNATI –– An Ohio appellate court has dismissed the appeal of an asbestos-related insurance dispute, finding that since the insurer’s substantial rights were not affected by a trial court ruling, the decision was not final and appealable.

In the July 9 opinion, the Ohio First Appellate District for Hamilton County noted that the trial court’s decision did not weigh in on the issue of allocation and, therefore, the rights of the parties under the relevant insurance policies had not been declared.
