N.C. Federal Court Grants Unopposed Motions for Summary Judgment in Asbestos Case

RALEIGH, N.C. –– A North Carolina court has awarded summary judgment to a number of asbestos defendants, noting the plaintiffs’ failure to respond or oppose the motions.
In a July 8 order, the U.S. District Court for the Eastern District of North Carolina accepted the defense arguments that the plaintiff had failed to prove that the decedent had been exposed to asbestos-containing products for which the defendants were responsible.
The plaintiffs asserted the claims on behalf of Robert Wesley Miller, contending that he was injured as a result of asbestos exposure.
