Del. Court Allows Asbestos-Related Lung Cancer Plaintiffs Additional Time to Amend Suit

WILMINGTON, Del. –– A Delaware federal court has allowed plaintiffs additional time to amend their complaint so that it complies with Florida’s pleading standards for asserting asbestos-related lung cancer claims.
In the July 2 order, the U.S. District Court for the District of Delaware cautioned the plaintiffs, however, that if the complaint isn’t filed by July 14, it may result in the dismissal of the suit with prejudice.
Florida residents Harry and Madonna Davis asserted the claims, contending that Harry Davis was exposed to asbestos-containing products and, as a result, developed lung cancer. The case was later removed to …
