N.Y. Court Affirms $12 Million Asbestos Judgments; Enforces Liability on Defendant for Replacement Parts

NEW YORK –– A New York appellate court has affirmed two asbestos judgments totaling more than $12 million, in part ruling that a defendant in one of the cases could be held liable for third-party replacement parts since it had a “substantial interest in having asbestos become the standard insulation in the components to be placed in its valves.”
In the July 3, 3-2 opinion, the New York Appellate Division, 1st Department, also found that the trial court’s decision to consolidate a construction site exposure case and a U.S. Naval exposure case was not erroneous.
