N.Y. Court Rejects Air Compressor Manufacturer’s Attempts to Challenge Product ID in Asbestos Case

NEW YORK –– A New York trial court has denied Gardner Denver’s motion for summary judgment in an asbestos case, concluding that there was a triable issue of fact as to whether the plaintiff came into contact with Gardner’s asbestos-containing air compressors.
In the June 4 order, the New York Supreme Court for New York County wrote that documents produced by the plaintiffs made it “abundantly” clear that the air compressors were on board the ship on which the plaintiff worked during the time period in question.
