N.C. Federal Court Dismisses False Representation/Fraud Claim in Asbestos Case

ELIZABETH CITY, N.C. –– A North Carolina has dismissed an asbestos plaintiff’s false representation/fraud claim, finding that the plaintiff had failed to establish how the defendants’ allegedly false representations resulted in the plaintiffs’ injuries.

In the June 9 order, the U.S. District Court for the Eastern District of North Carolina noted that the plaintiff had chosen not to respond to dismissal efforts made by eight defendants and, as such, the order dismissing the claim will be entered as to all defendants remaining in the case.
