Del. Magistrate Judge Recommends Dismissal of Several Asbestos Claims in Mechanic Exposure Suit

WILMINGTON, Del. –– A magistrate judge has recommended that a number of asbestos claims be dismissed in a mechanic exposure case, concluding that the plaintiffs had failed to link the defendants’ actions to the causes of action.

In the May 20 report and recommendation, Magistrate Judge Christopher J. Burke of the U.S. District Court for the District of Delaware opined that the plaintiffs had not made any factual allegations that could “plausibly” connect the defendants to the alleged injury.
