Baltimore Judge Tosses ‘Apparent Manufacturer’ Claims Against Pfizer in Asbestos Case Involving Subsidiary’s Product

BALTIMORE –– A Baltimore trial judge has awarded summary judgment to Pfizer Inc. in a case involving Insulag, an asbestos-containing product manufactured by the defendant’s bankrupt subsidiary, Quigley Company Inc., finding that a “reasonable” person could not conclude that Pfizer was the manufacturer of the product.
According to a June 2 transcript, Judge John M. Glynn of the Maryland Circuit Court for Baltimore County court rejected the plaintiffs’ attempts to enforce liability on Pfizer in the civil action under the apparent manufacturer theory of liability instead of through the bankruptcy claims process.
