Pa. Appellate Court Affirms Nearly $1 Million Verdict; Rejects Challenges to ‘Each and Every Exposure’ Testimony

HARRISBURG, Pa. –– A Pennsylvania appellate court has affirmed a nearly $1 million asbestos verdict, finding the record “easily distinguishable” from that in another asbestos case where the state high court rejected “any exposure” testimony.
In the May 19 opinion, the Pennsylvania Superior Court opined that the state’s high court decision in Betz v. Pneumo Abex LLC, does not mandate that every judge throw out expert opinion that relies on a “no known threshold” theory of exposure. [615 Pa. 504, 44 A3d 27, 2012].
