SEATTLE –– A Washington federal court has denied an asbestos plaintiff’s motion to reconsider an earlier ruling precluding expert testimony that relied on a study relating to asbestos-containing hot tops, opining that the plaintiff had failed to present newly discovered evidence that was unavailable at the time of the first ruling.

In the May 19 opinion, the U.S. District Court for the Western District of Washington maintained its stance that the study relied upon by the plaintiff expert was not admissible.

Joanne Lipson asserted the claims, contending that her husband was exposed to asbestos while working at a steel mill. …
