Calif. Appellate Court: Asbestos-Related Duty to Warn Can Extend to Employee’s Nephew Who Spent Time in Uncle’s Home

SAN FRANCISCO –– A California appellate court has reversed a nonsuit judgment entered in favor of asbestos defendant Pneumo Abex LLC, opining that the defendant’s duty to warn could extend to the nephew of one of its employees.
In the May 15 opinion, the First District of the California Court of Appeal did caution that its finding was not one of negligence and noted that factual determination remained regarding how much time the plaintiff spent in his uncle’s home during the years in question.
