N.Y. Appellate Court Affirms Order Denying Efforts to Dismiss Claims Against Dissolved Asbestos Defendant

NEW YORK –– A New York appellate court has upheld an order rejecting attempts to dismiss several asbestos suits against Jenkins Bros., affirming that the now-dissolved company is still amenable to suit under New Jersey’s laws of state incorporation.
In the April 17 order, the 1st Department of the Appellate Division in the New York Supreme Court also found that service on Jenkins Bros. former insurer, Liberty Mutual Insurance Co., was proper since the insurance company agreed to defend and indemnify the asbestos defendant for injuries that occurred during the coverage period.
