2nd Circuit Affirms $980,000 Judgment Entered Against Cleaver Brooks in Asbestos Case

NEW YORK –– The U.S. Court of Appeals for the 2nd Circuit has upheld a nearly $1 million judgment entered against Cleaver Brooks, finding that the plaintiff presented enough evidence at trial to support a causal link between the defendant’s asbestos-containing boilers and the decedent’s illness.
In the April 10 opinion, the 2nd Circuit also found that, under Kansas law, a defendant is not entitled to setoffs for prior settlement agreements between the plaintiffs and other parties.
Kelly McCormick brought the claims on behalf of her husband, Kit L. McCormick, who was injured allegedly as a result of asbestos exposure. …
