BIRMINGHAM, Ala. –– An Alabama federal court has awarded summary judgment to defendants in two separate asbestos cases, finding in the first case that the state’s statute of limitations bars the claims.
In the second of the two Feb. 21 opinions, the U.S. District Court for the Northern District of Alabama also predicted that while the state would most likely recognize the “two-disease rule,” a previous settlement agreement precluded the second asbestos lawsuit.
MW Customer Papers LLC and MeadWestvaco Corp. filed the underlying motions for summary judgment.
