Wash. Court Reverses Summary Judgment for Flowserve in Asbestos Case, Says Deposition Testimony Wrongfully Excluded

SEATTLE –– A Washington appellate court has reversed an award of summary judgment entered in favor of asbestos defendant Flowserve US Inc., ruling that the deposition of a former Puget Sound Naval Shipyard worker taken in a separate case did not constitute hearsay.

In the March 3 opinion, the Washington Court of Appeals, Division I, wrote that the manufacturers that were present for the deposition of the now-deceased worker all had the similar motive of discrediting his testimony.
