California Federal Court Remands Asbestos Case, Cites Plaintiff’s Waiver of Federal Claims

OAKLAND, Calif. –– A California federal court has remanded an asbestos action, noting that the plaintiff had expressly waived any claims relating to military or federal government worksites.

In the Feb. 26 opinion, the U.S. District Court for the Northern District of California wrote that should the asbestos plaintiff change his position –– and attempt to bring such claims –– defendant Crane Co. will be permitted to remove the case at that time.
