Del. High Court Affirms Dismissal of Asbestos Suits Brought by Argentine Nationals Against DuPont

DOVER, Del. –– The Delaware Supreme Court has upheld the dismissal of an asbestos exposure suit brought by an Argentinean citizen against DuPont (NYSE:DD), ruling that overseeing the claims would result in overwhelming hardship since the court would be asked to determine “complex and unsettled” issues of tort law in a foreign language.
In the Feb. 20 opinion, the court agreed with a trial court’s finding that underlying Argentine law issues were “best determined by the Argentine courts.”
