Del. Court Applies Florida Act Requiring Prima Facie Evidence to Lung Cancer Asbestos Case

WILMINGTON, Del. –– A Delaware federal court has recommended dismissal of a Florida couple’s asbestos lung cancer lawsuit after determining that requirements of the state’s Asbestos and Silica Compensation Fairness Act could apply to the out-of-state claims.
In the Feb. 21 report and recommendation, U.S. Magistrate Judge Christopher J. Burke of the U.S. District Court for the District of Delaware found that the Florida legislation is substantive in nature, making state laws ¬¬–– such as those requiring a smoker to present prima facie evidence in a lung cancer case –– applicable.
