Del. Court Dismisses Claims Against Asbestos Pump Manufacturers, Cites Insufficient Product Identification Evidence

WILMINGTON, Del. –– A Delaware court has dismissed lung cancer asbestos claims filed against pump manufacturers, finding that the plaintiffs had not presented enough evidence to link the alleged injury to exposure in the defendants’ products.
In the Feb. 14 order, the Delaware Superior Court for New Castle County declined to make a decision on whether maritime law or Arkansas law governed the case, saying that the plaintiffs failed to satisfy causation standards under either law.
