La. Court Grants Joint Motion to Dismiss Dispute Involving 3rd-Party Claims in Take-Home Exposure Asbestos Case

GRETNA, La. –– A Louisiana appellate court has granted a joint motion to dismiss an asbestos-related appeal, noting that since requesting review of the underlying dispute, the two defendants had reached a resolution.

In the Feb. 12 opinion, the Louisiana Fifth Circuit Court of Appeal noted that the underlying case involved whether a third-party defendant was wrongfully granted summary judgment in a case concerning take-home exposure claims.

Leonard Abadie Jr. filed the complaint, contending that his exposure to asbestos caused him to develop mesothelioma. Abadie has since died, the court noted.
