Calif. Court Remands Asbestos Action, Cites Plaintiff’s Waiver to All Military-Based Exposure Claims

SACRAMENTO, Calif. –– A California federal court has remanded an asbestos action, citing a waiver to all military-related claims filed by the plaintiff shortly after the case was removed.
In the Jan. 23 order, the U.S. District Court for the Eastern District of California rejected the contentions of Crane Co., the removing defendant, that the waiver was invalid since it was not filed until after the case was removed.
Paul Schulz filed the underlying asbestos-related complaint in Solano County Superior Court. Shortly thereafter, Crane Co. removed the lawsuit, arguing that the government contractor defense was available.
