PROVIDENCE, R.I. –– A Rhode Island court has denied efforts to preclude a plaintiffs’ naval expert from testifying in an upcoming asbestos trial, saying that although the expert is a late substitution, it will not prejudice the defendant.
In the Jan. 15 order, the Rhode Island Superior Court said that it will allow Capt. William Lowell to testify on behalf of the plaintiff since his inclusion does not violate Super. R. Civ. P. Rule 33(c) or Rule 26 (e).
