Lennox Appeals Orders Denying Motions for Summary Judgment in Asbestos NYC Cases

NEW YORK –– Lennox Industries Inc. has appealed two decisions in which a New York state court denied the asbestos defendant summary judgment on grounds that the disputes are ones of credibility, which are matters to be determined by a jury.

Lennox filed the notice of appeal on Jan. 3. In separate orders issued Dec. 20, Judge Sherry Klein Heitler of the New York Supreme Court for New York County denied the defendant’s motions for summary judgment, ruling that questions regarding the plaintiff’s identification of the defendant’s product were ones for a jury.
