Calif. Appellate Court Issues Published Opinion on Deposition Time Limits in Asbestos Cases

LOS ANGELES –– A California appellate court has responded to a trial court’s request to issue a published opinion on a trial court’s authority to allow additional deposition time in asbestos cases, reiterating its earlier stance that such extra time is permitted on a case-by-case basis.

In the Jan. 8 published opinion, the California 2nd District Court of Appeal ruled that a provision permitting a trial court to allow extra deposition time applies to both a seven-hour limit and a 14-hour limit outlined in two separate subsections in the Code of Civil Procedure Section 2025.290.
