N.Y. Court Denies Summary Judgment Motion from Dana Companies in Asbestos Gasket, Clutch Case

NEW YORK –– Dana Companies’ attempts to obtain summary judgment have been rejected by a New York trial court on grounds that the asbestos plaintiff had established that exposure to the defendant’s clutches and gaskets could be reasonably inferred.
On Dec. 23, the New York County Supreme Court found the plaintiff’s testimony had shown that there was actual exposure to asbestos fibers in the defendant’s products.
