W.Va. Court Upholds Benefits Award to Former Bayer Corp. Employee Asserting Asbestos Exposure

CHARLESTON, W.Va. –– A West Virginia appellate court has upheld an award of benefits to the widow of a former chemical operator who allegedly developed testicular mesothelioma as a result of occupational exposure to asbestos.

In the Nov. 18 decision, the West Virginia Supreme Court of Appeals found no error with the Workers’ Compensation Board of Review’s decision that the decedent’s exposure to asbestos while working for Bayer Corp. contributed to the development of his illness.

Bayer Corp. filed the appeal, contesting the decision of the Workers’ Compensation Board of Review.
