NEW YORK –– A New York trial court has denied attempts by Con Edison to dismiss asbestos claims, saying that the plaintiff’s testimony was enough to defeat the motion for summary judgment.
In the same Nov. 4 decision, the New York Supreme Court for New York County dismissed the plaintiffs’ Labor Law claims, noting that the defendant’s efforts to dismiss that claim were unopposed.
