NYC Court Denies Con Edison’s Motion to Dismiss Asbestos Claims of Steamfitter

NEW YORK –– A New York trial court has denied attempts by Con Edison to dismiss asbestos claims, saying that the plaintiff’s testimony was enough to defeat the motion for summary judgment.

In the same Nov. 4 decision, the New York Supreme Court for New York County dismissed the plaintiffs’ Labor Law claims, noting that the defendant’s efforts to dismiss that claim were unopposed.

Consolidated Edison Company of New York Inc. moved to dismiss several claims, including the plaintiffs’ Labor Law § 200 cause of action, arguing that the plaintiffs had failed to demonstrate that the defendant controlled the work …
