Court Won't Reconsider Summary Judgment Award to Asbestos Contractor

PROVIDENCE, R.I. - A Rhode Island court has refused to reconsider its recent decision to grant summary judgment to a refractory on grounds that the underlying asbestos claim was barred by the statute of repose. Diane Muliero v. ACandS, Inc., et al., No. 99-2703 (R.I. Super. Ct.).

In a decision issued Oct. 16, the Rhode Island Superior Court in Providence rejected a plea by Diane Muliero to vacate or, in the alternative, reconsider its Sept. 4 decision awarding summary judgment to Eastern Refractories Company, Inc. (ERCO), which distributed and installed insulation and refractory materials containing asbestos.
