NYC Asbestos Defendants Threaten to Withdraw Support of CMO if Punitive Damages are Reinstated

NEW YORK –– Defendants involved in New York City’s coordinated asbestos docket have threatened to withdraw their consent to the Case Management Order and Special Master if the court grants recent attempts by the plaintiffs to reinstate punitive damages.

In Oct. 31 motions filed in the New York Supreme Court for New York County, the defendants argue that the plaintiffs’ request would “erode the efficacy of the CMO.”
