Ill. Court Awards Summary Judgment to Power Plant Owners, General Contractor, Designer in Asbestos Case

CHICAGO –– An Illinois federal court has dismissed asbestos claims asserted against two owners, a general contractor and a designer of several power plants at which asbestos exposure allegedly occurred, concluding that several of the defendants did not owe the decedent a duty of care.

In the Oct. 22 opinion, the U.S. District Court for the Northern District of Illinois additionally found that since asbestos-containing thermal insulation is an improvement to real property, the claims are also barred under the statute of repose.
