NYC Judge Consolidates 3 Asbestos Lung Cancer Cases for Trial; Groups 4 Mesothelioma Cases Separately

NEW YORK –– A judge overseeing the coordinated New York City asbestos docket has issued an order consolidating three lung cancer cases for trial, according to a recent order.

In the same Oct. 18 order, the New York Supreme Court for New York County declined to group a total of seven mesothelioma cases for trial, noting that three of those cases may involve the government contractor defense.

The plaintiffs asked the court to consolidate the claims into two groups; the first group, consisting of mesothelioma plaintiffs, would involve claims asserted in Dietrich, Lamberty, Marino, McDonald, Pendergats and Yetter. The …
