N.J. Court Reverses $1.7 Million Verdict, Says Statute of Repose Bars Asbestos Claims Against Foster Wheeler

TRENTON, N.J. –– A New Jersey appellate court has reversed a $1.7 million asbestos verdict entered against Foster Wheeler, ruling that the plaintiffs’ claims relating to one of the defendant’s custom boilers are barred by the statute of repose.

In its Sept. 4 opinion, the Appellate Division of the New Jersey Superior Court held that the installation of the boiler –– which contained asbestos insulation –– was not complete until Foster Wheeler completed repairs necessary to get the boiler working properly.
