Pa. Supreme Court Reverses Decision on Asbestos Causation Standard Upon Agreement by Parties

PHILADELPHIA –– The Pennsylvania Supreme Court has reinstated a trial court’s award of summary judgment to several asbestos defendants, noting that the plaintiffs had recently “conceded” that the factual record failed to exhibit “frequent and regular” exposure to asbestos fibers from the defendants’ products.

In the Sept. 26 order, the high court reversed an intermediate appellate court and noted that the appeal had been “resolved upon mutual consent among the parties, who agree that the order of the Superior Court should be reversed.”
