N.Y. Court Denies Valve Manufacturers Efforts to Dismiss Asbestos Case, Says Defendant Failed to Address Original Packing in Motion

NEW YORK – A New York trial court has denied efforts by a valve manufacturer to obtain summary judgment in an asbestos case, accepting a co-worker's testimony indicating that the decedent had worked with the defendant's product.
In the Oct. 7 decision, the New York Supreme Court for New York County ruled that while Milwaukee Valve Co. addressed replacement packing, it did not successfully refute the possibility that the decedent could have been exposed to asbestos in the original packing.
