Tenn. Court: State Law Controls Calculation of Post-Judgment Interest in Asbestos FELA Action

NASHVILLE, Tenn. –– A Tennessee appellate court has determined that both the amount and accrual date of post-judgment interest in an asbestos FELA action is governed by state law, according to a recent opinion.
In the Oct. 9 decision, the Tennessee Court of Appeals affirmed a verdict for a former CSX Transportation worker in all other aspects, including causation rulings that were contested by the defendant.
Plaintiff William J. Denning filed the claims, contending his employment with CSX Transportation as a brakeman and engineer exposed him to a variety of toxins, including asbestos, diesel exhaust and other carcinogens. In the …
