Wis. Court Reverses Position on Applicability of Statute of Repose to Asbestos Claims, Grants Procter & Gamble’s In Limine Motion

MILWAUKEE – A Wisconsin federal court has granted an asbestos defendant’s motion to exclude certain asbestos claims on statute of repose grounds, finding the claims were not subject to an exception of the statute as the court previously determined.

On Oct. 4, the U.S. District Court for the Eastern District of Wisconsin reversed its position on the matter, concluding that the statute’s use of the word “damages” was unclear. While the court excluded evidence relating to the decedent’s alleged exposure on projects involving improvements to real property, it allowed claims arising from exposure outside of those projects to proceed.
