La. Court Remands Asbestos Lawsuit, Rejects Removal Efforts of Employee, Insulator Defendants

NEW ORLEANS –– A Louisiana federal court has remanded an asbestos action, finding that the employee and insulator defendants that cited diversity jurisdiction when removing the case were properly joined.

In the Sept. 23 decision, the U.S. District Court for the Eastern District of Louisiana opted not to address causation issues raised by the insulation defendants, opining that it was too “early” in the proceedings to make a determination on scientific testimony.

Plaintiff Ronald R. Caire Sr. filed the lawsuit, contending that he developed bladder cancer after being exposed to toxic and carcinogenic substances, including asbestos, during his employment …
