Pa. Court Reverses $14.5 Million Asbestos Verdict; Rejects ‘Each and Every’ Exposure Causation Theory

HARRISBURG, Pa. –– A $14.5 million asbestos verdict has been reversed by a Pennsylvania appellate court which found that the “each and every” exposure causation testimony offered by a plaintiff expert witness was inadmissible.
In a Sept. 5 opinion, the Pennsylvania Superior Court additionally found that the trial court erred when allowing plaintiffs’ counsel to make suggestions as to verdict amounts during closing arguments.
As such, the Superior Court reversed both the liability and damages judgments in the reverse bifurcated trial and remanded the case for a new trial.
