Take-Home Asbestos Exposure Claims Can Proceed Against Alcoa, MDL Court Rules

PHILADELPHIA –– A Tennessee plaintiff has presented sufficient evidence to support take-home asbestos exposure claims against Alcoa, the national MDL Court has found.

In the Aug. 8 order, the U.S. District Court for the Eastern District of Pennsylvania additionally ruled that the plaintiff did not violate any state laws when it failed to preserve the decedent’s lung tissue.

Robert Millsaps filed the claims, contending that his wife, Brenda Millsaps, developed mesothelioma at the age of 46. Brenda Millsaps was exposed to asbestos through the clothes of her father-in-law, who worked for Aluminum Company of America (Alcoa) from 1955 to 1957 …
