Asbestos MDL Court Awards Summary Judgment to Georgia-Pacific, Excludes Decedent’s Affidavit

PHILADELPHIA –– The Asbestos Products Liability MDL Court has awarded summary judgment to Georgia-Pacific in a joint compound case, finding that the plaintiff failed to establish product identification.

In the Aug. 12 order, the U.S. District Court for the Eastern District of Pennsylvania also found that an affidavit executed three days before the decedent’s death was not admissible under the “deathbed declaration” exception to the hearsay rule.

Jill Farrell asserted the claims on behalf of Howard James Farrell, contending that he was exposed to asbestos-containing joint compound while performing personal home repair and automotive work.
