NYC Asbestos Special Master Reverses Position on Forum Ruling, Grants Defense Objections

NEW YORK –– A New York special master has reconsidered a recommendation that allowed an asbestos plaintiff asserting only a few days of exposure in the city to be added to the Oct. 2013 in extremis cluster, concluding that she shouldn’t have used an expert report in reaching her decision.

In the Aug. 22 recommendation, Special Master Shelley Rossoff Olsen of the New York Supreme Court for New York County reversed her earlier position and granted a defense objection to forum in the case.
