Del. Court Refuses to Reconsider Dismissal of Asbestos Claims Against Ford Motor Involving Third-Party Replacement Parts

WILMINGTON, Del. –– A Delaware court has refused to reconsider its ruling dismissing asbestos claims against Ford Motor Co. (NYSE:F), finding the plaintiffs did not raise new arguments that would support the enforcement of liability against Ford for replacement brakes supplied by a third party.

In the Aug. 19 decision, the Delaware Superior Court for New Castle County reiterated the reasoning in its earlier ruling, which concluded that while Ford Motor should not be absolved of liability arising from exposure to asbestos in its own brakes, liability for a third-party’s brakes could not be enforced on the defendant.
