N.C. Court Denies Motion to Dismiss on Venue Grounds, Even Though ‘Majority’ of Asbestos Exposure Occurred in CT

RALEIGH, N.C. –– A North Carolina federal court has opted to retain jurisdiction over an asbestos case, saying that although the majority of the alleged asbestos exposure occurred in Connecticut, a period of exposure in North Carolina is not “immaterial.”

In an Aug. 14 decision, the U.S. District Court for the Eastern District of North Carolina additionally dismissed several cross-claims as moot and allowed the dismissal of the claim for loss of consortium.

The plaintiffs asserted the claims on behalf of Robert Wesley Miller, who was allegedly exposed to asbestos-containing products during his employment from the 1950s to the 1990s. …
