N.Y. Court Declines to Award Summary Judgment to Crane Co., Says Questions of Fact Raised Against Asbestos Defendant

NEW YORK –– A New York trial judge has declined to award summary judgment to Crane Co. in an asbestos case, saying that the plaintiff’s own testimony raised a material question of fact as to whether he was exposed to asbestos fibers released from boilers.

In the Aug. 8 decision, the New York Supreme Court for New York County further opined that Crane. Co. had a duty to warn consumers of asbestos hazards since it recommended the use of asbestos-containing products in conjunction with its boilers.
