Ship Defendant Denied Summary Judgment by NY Court in Asbestos Case

NEW YORK –– A defendant responsible for two U.S. Naval ships on which the plaintiff alleges he was exposed to asbestos has been denied summary judgment, after a trial court found that granting such a motion would be “premature.”

In the Aug. 12 order, the New York Supreme Court for New York County opined that further discovery was needed on product identification issues since the plaintiff passed away before the defendant had an opportunity to question him.

The trial court also denied Farrell Lines Inc.’s objections to the service of the complaint and summons.
