NEW YORK –– A New York trial court has denied Ingersoll Rand’s efforts to obtain summary judgment in a naval asbestos exposure case, saying that the decedent’s own deposition testimony is enough to create a question of fact.
In the July 29 decision, the New York Supreme Court for New York County rejected the defendant’s contention that the decedent’s failure to remember specific facts justified dismissal of the claims against Ingersoll Rand, concluding instead that “the weight to be accorded to his testimony” should be assessed by a trier of fact.
