Conn. Court Affirms Dismissal of Asbestos Claims, Says Widow Failed to Substitute Herself as a Plaintiff

HARTFORD, Conn. –– A Connecticut appellate court has affirmed the dismissal of an asbestos action in which the plaintiff failed to insert herself as a party plaintiff following her husband’s death.

In the Aug. 6 opinion the Connecticut Court of Appeals agreed with a trial court’s decision that the plaintiff had failed to present a compelling reason why she did not substitute herself as a plaintiff.

Ernest Kalb initially filed the suit in 2004, contending that he had developed asbestos-related injuries. Kalb died in 2008 but his widow, Marianna Kalb, failed to substitute herself as the party plaintiff. Marianna Kalb, …
