PORTLAND, Ore. –– The Oregon Supreme Court has reversed an intermediate appellate court’s decision to throw out a $800,000 default judgment in an insurance action involving a dispute over indemnification of an underlying asbestos settlement.
In the July 25 ruling, the high court found that while Portland General Electric Co. had failed to state a monetary claim for relief in its declaratory action, Lexington Insurance Co.’s challenges to a subsequent default judgment were “too late.”
