Wash. Court Remands Asbestos Case, Finds Plaintiff Has Colorable Claims Against In-State Resident Saberhagen

TACOMA, Wash. –– A Washington court has remanded an asbestos action, finding that the plaintiff had asserted colorable claims against Saberhagen Holdings, a Washington resident.

In the July 29 opinion, the U.S. District Court for the Western District of Washington noted that Saberhagen’s bankruptcy proceedings have been dismissed and the stay on claims against the company had been lifted.

Peter E. Jensen filed the lawsuit, contending he developed mesothelioma and lung cancer as a result of exposure to asbestos-containing products while serving in the U.S. Navy as a heavy equipment operator.
