HOUSTON –– A Texas appellate court has declined to reverse a lower court decision that denied a stay in a lawsuit arising from a dispute with a trust created to address asbestos claims asserted against Pneumo Abex.
In the July 25 decision, the Texas 14th Court of Appeals noted that since the plaintiff in the instant action was not a party in the original proceedings in a New York court that resulted in the settlement, comity does not exist.
